THE CONSTITUTIONAL CHEROKEE

ARTICLES OF ORGANIZATION AND GOVERNMENT

PREAMBLE
Whereas our Ancestors have existed as a sovereign nation in the homeland that our Creator bestowed to us since time immemorial, 


We, the Cherokee people, in order to establish justice, ensure tranquility, promote our common welfare, and secure to ourselves and our posterity the blessings of liberty; acknowledging with humility and gratitude the goodness of the Sovereign Ruler of the Universe, 
in offering us an opportunity so favorable to the design, and imploring Creator's aid and direction in our accomplishment, do ordain and establish the Constitution for the Government of the Cherokee people who have documented descent from a Cherokee ancestor.

The Articles of Organization are to be observed and followed by every member of the Constitutional Cherokee.
The Articles of Organization and Government themselves may not be amended or altered except in accord with the requirements set forth in Article XXII - Amendments of these Articles of Organization and Government.
No law or ruling by any level of government or by any power outside of our nation shall ever have the power to negate or alter any of these Articles or the contents of our Handbook; these may not be changed except as provided for within this Handbook and as described in the Articles dealing with Amendments.
Failure to abide by the Articles of Organization and Government by any member of the Constitutional Cherokee may be seen as just cause for action against that member and anyone found guilty of such an infraction is to be treated in accordance with the judgment of the local council and the guidelines set forth in our special rules; Action against the offender is not limited to fines or public censure and also may include the possibility of either temporary or permanent dis-enrollment and or banishment in accordance with the special rules of the Handbook.
We, the members of the Constitutional Cherokee, shall endeavor at all times to live as Cherokee and conduct ourselves in ᏚᏳᎪᏛ du-yu-go-dv

This Constitution shall supersede the previously adopted Constitution.
Section 1. All members of the Constitutional shall enjoy without hindrance freedom of worship, conscience, speech, press, assembly and association of and for themselves or with other enrolled Constitutional Cherokee members.
Section 2. This Constitution shall not in any way be construed to impair, abridge or otherwise jeopardize the rights and privileges of the enrolled documented by descent members of the Constitutional as citizens of their State of residence or of the United States.
Section 3. The individual vested property rights of any member of the Constitutional shall not be impaired, abridged or otherwise affected by the provisions of this Constitution and By-laws without the consent of such individual member with the exception that all lands within the homeland may not be sold by an enrolled member to anyone else who is not also an enrolled member by descent.

NOTE: Our Cherokee Ancestors had a complex and highly developed political and spiritual system in place that was NOT understood by the invading governments.  Those invaders tended to simplify our system and rename parts of it to correspond with their own.  In some cases, they totally ignored our system and put their own idea of government in its place, refusing to deal with any of our traditional leaders.  This is obvious in the explanations of the encounters with Moytoy and also with the way our women were disregarded and the men who did not own the land were consulted for the purpose of trading the land.  This Handbook seeks to rectify those misconceptions.
